(1) DISCLOSURE OF YOUR PERSONAL CONTACT INFORMATION;
(2) YOUR RIGHT TO PREVENT THIS POTENTIAL DISCLOSURE OF CONTACT INFORMATION
ATTENTION to all persons who have been, or currently are, employed by Defendant NIKE Retail Services, Inc., in the State of California who are lactating parents, e.g., individuals who express milk for their infant children or others from May 8, 2020 to the present.
You are receiving this notice because Plaintiff Fantasia McDonald (“Plaintiff”) has filed a lawsuit (described below) against NIKE Retail Services, Inc. (“NIKE”) that seeks class action treatment. Plaintiff’s attorneys want your contact information so that they can communicate with you in furtherance of their investigation of the facts relating to their allegations in the lawsuit.
Plaintiff has asked NIKE to provide to the Plaintiff’s attorneys your:
- name,
- home address, and
- home/cell telephone number(s), and
- email address.
If you agree to disclose your contact information, the information will only be shared with Plaintiff’s attorneys and will be treated as confidential pursuant to a protective order entered into between the Parties. However, you have the right to request that your name and contact information not be provided to Plaintiff’s attorneys.
IF YOU DO NOT TAKE ACTION AS OUTLINED IN THIS NOTICE BY JANUARY 26, 2026, YOUR NAME AND CONTACT INFORMATION WILL BE PROVIDED TO PLAINTIFF’S ATTORNEYS, AND THEY MAY CONTACT YOU. Regardless, if you respond to this notice and, if you are contacted by Plaintiff’s attorneys, you may choose to speak to them, but you may also choose not to speak to them. You will not be retaliated against by NIKE whether you choose to speak to Plaintiff’s Attorneys or not.
- THE LAWSUIT
In addition to pursuing claims on her behalf, Plaintiff seeks to also assert claims on behalf of a class of persons who have been, or currently are, employed by NIKE in the State of California who are lactating parents, e.g., individuals who express milk for their infant children or others from May 8, 2020 to the present. Plaintiff is seeking your contact information in order to investigate whether representative claims are appropriate in this lawsuit.
The lawsuit alleges the following claims: (1) failure to provide reasonable accommodations and advance reasonable notice for pregnancy; (2) failure to engage in the interactive process to reasonably accommodate lactation; (3) violation of California Labor Code § 1030; (4) violation of California Labor Code § 226.7; (5) violation of California Labor Code § 226; (6) violation of California Labor Code §§ 201-203 (waiting time penalties); (7) unfair competition in violation of the Unfair Competition Law; and (8) Private Attorney’s General Act (California Labor Code § 2699 et seq.). The lawsuit seeks monetary damages for the asserted Fair Employment and Housing Act, California Family Rights Act, and Labor Code violations, as well as civil and statutory penalties.
NIKE denies any liability or wrongdoing of any kind with respect to the lawsuit’s allegations and opposes Plaintiff’s claims. NIKE maintains legally compliant procedures for handling lactation accommodation requests and follows the law with respect to handling of all requests for lactation accommodation. NIKE also believes that Plaintiff should only pursue claims on an individual basis and that a class action is not appropriate in this case.
The Court in this lawsuit has not determined whether the lawsuit should proceed as a class action, and no decision by the Court has been made on the merits of Plaintiff’s claims.

YOUR CONTACT INFORMATION MAY BE DISCLOSED UNLESS YOU RESPOND BY JANUARY 26, 2026.
- Disclosure of Your Personal Contact Information
If you DO consent to your personal contact information to be provided to the Plaintiff and her attorneys: Do nothing. By doing nothing, your name, home address, telephone number, and email-address on record will be released to Plaintiff’s attorneys.
If you DO NOT consent to your personal contact information to be provided to the Plaintiff and her attorneys: Sign and return the enclosed pre-paid and pre-addressed postcard on or before January 26, 2026, or complete the online form available at www.NikeClassActionLawsuit.com. If you return the postcard or complete the online form by January 26, 2026, your name, home address, telephone number, and email address on record will not be released to Plaintiff’s attorneys.
Your decision to withhold your name and contact information at this time will have no impact on any right you may have to participate in this case in the event it is later certified as a class action.
